Couple suing over road work
JOHNSTOWN – A Dolgeville couple is suing the town of Oppenheim and town Superintendent of Highways Richard Crum for nearly $500,000 in a dispute related to road work.
Charles F. Johnson and Helen Johnson – represented by Palatine Bridge attorney Kenneth L. Ayers – filed a civil lawsuit Tuesday in state Supreme Court in Johnstown seeking $496,349 from the town and Crum.
The lawsuit says Crum and his crew on July 16 went on the Johnsons’ property without their permission and “wrongfully and unlawfully” widened the road, removing trees and shrubs. The suit says the work led to erosion and washouts.
“The defendant and town has failed or refused to cease and desist from such unlawful trespasses,” court papers stated.
