City man accused of sex with underage girl

GLOVERSVILLE – The city police arrested a man Wednesday for the rape of a 15 year-old girl after he had intercourse with her several times in November and Decembe of last year, police said.

Patrick J. Higgs, 30, of 82 Fremont St. apartment 4, was charged with third-degree rape, a class E felony.

Third degree rape is commonly known as statutory rape.

Detective Sgt. Mike Jory said Higgs didn’t force the juvenile into the sexual acts but due to the victim’s age and inability to provide legal consent he was charged with rape.

He said the girl was living within close proximity to Higgs which is how the incidents between the two developed.

“There is no family relationship between them, it was just an acquaintance,” Jory said.

Authorities said Higgs had sexual intercourse with the girl several times in November and December.

However, Jory said, police didn’t become aware of the relationship until December at which point they began an investigation.

“It wasn’t disclosed to us until mid-December,” Jory said. “We used a few investigative tools and some different procedures to make sure we had a closed case. With cases involving young kids we don’t want to put them through any more than we have to.”

Higgs was arraigned in City Court Judge and sent to the Fulton County Jail in lieu of $25,000 cash bail.
