Man charged with sex crime
MAYFIELD – A man accused in federal court of producing child pornography was in Town Court on Tuesday to face local charges.
Richard Hastings, 18, of 171 Yates Road, pleaded not guilty to first-degree sexual abuse and endangering the welfare of a child.
Both Richard and his brother, Robert Hastings, 21, were charged in August by federal authorities with producing child pornography.
Authorities said between July 27 and 29, Richard Hastings produced sexually explicit photographs of a child and posted some of them on a website. He also emailed some to an undercover investigator with Queensland Police Services in Australia, authorities said. According to an affidavit, an assessment of the victim by a therapist revealed the victim said the Hastings brothers touched her private area.
In court Tuesday, Richard Hastings was quiet, aside from answering Town Justice John Papa’s questions. Attorney Lee Greenstein, who is representing Richard Hastings in federal court, was not in attendance, but Fulton County District Attorney Louise Sira said Greenstein had suggested another attorney. Papa assigned a court appointed attorney and scheduled an appearance in court for Nov. 12.
Sira said Richard Hastings’ case would need to go before the grand jury before a trial would start. Sira also said she would need to speak with federal prosecutors on how to proceed.
Sira said bail would not be an issue since Richard Hastings was still being held on federal charges. Papa set bail of $1,000 cash bail or $2,000 bond.
Robert Hastings was previously released into the custody of his parents. Federal prosecutors are appealing teh release.
